Warminster Storage Ltd – Terms and Conditions:
Please read the Terms and Conditions below, then click on accept prior to placing your order with us.
- Warminster Storage Limited (“WSL”) shall allow you to hire out a self storage container in return for payment of the storage fee set out on the website. The agreement will continue until terminated by either party on the giving of a weeks notice.
- Your use of the container is by way of a Licence. You are not granted exclusive possession of any particular container and agree to move your possessions to another container as directed by WSL (which shall not be smaller) on the giving of 7 days notice.
- Access to the site is permitted between the hours of 7.00a.m. And 5.00 p.m. with access at any other time by prior arrangement only.
- You must not store any of the following in the container: food or perishable goods; plants, birds, fish, animals or any other creature; combustible or flammable materials; firearms, ammunitions, weapons or explosives; chemicals, radioactive materials, toxic waste, asbestos, or any other materials of a potentially dangerous nature; any items which emits fumes, smell or odour; any illegal substances, illegal items or items illegally obtained; compressed gases; any items of a high value requiring specialist storage.
- You warrant that any goods stored in the container are your own property or that the person who owns the goods have given you authority to store the goods in the container and that you are acting as their agent. You agree to indemnify WSL against any loss or damage suffered as a result of a breach of this warranty, to include any reasonably incurred legal fees arising from any action taken by any person who owns or has an interest in the goods.
- Trading is only permitted from the site if stipulated on the front of this agreement. Unless WSL has granted permission to trade, you may not use the container to carry out a business, as an office or to receive post or mail. You may not use the container for living accommodation under any circumstances.
- You agree to make payment for any services that you arrange to be provided to the container, which need to be confirmed prior.
- Should you request the connection of electricity to your container, you agree to make payment direct to WSL for the cost of electricity supplied on request.
- You may not affix anything to the floor, walls or ceiling of the container. You will take all reasonable care when using the container. You will notify us immediately of any damage caused to the container, and agree to make payment for the cost of repair or replacement for any damage caused.
- You agree to comply with any reasonable directions given by WSL or it’s staff.
- You agree to provide us with an inventory of the goods in the container upon request.
- Storage of the goods in the container is at your own risk. WSL recommend that you take out insurance, this is not provided by WSL. In the event that you choose not to take out insurance, WSL require you to read and confirm when booking and paying the insurance disclaimer form.
- Payment is to be made weekly in advance by way of standing order or Credit/Debit card. WSL reserves the right to charge interest on late payment at the rate of 10% per annum.
- WSL may alter the storage fee at any time on the giving of 28 days notice.
- In the event of payment being more than 7 days late, WSL will take steps to contact you as a reminder. You agree to make payment of the following administration charges: £5.00 per text message, £15.00 per letter, £10.00 per e-mail, £10.00 per telephone call.
- In the event of payment being more than 14 days late, WSL reserves the right to terminate the agreement. Upon termination your right to store goods in the container shall be at an end and you will arrange for the removal of your goods with immediate effect.
- In the event of payment being more than 14 days late, WSL are relieved of any duty howsoever arising in respect of the goods; and shall be able to immediately exercise the lien described in clauses 18-21 below.
- You agree that WSL has a lien over the goods stored in the container until payment of the outstanding charges (and any administration costs) in full by way of cleared funds. After this lien becomes exercisable by WSL, you shall pay WSL fees and charges at the same rates as under this Licence and if this Licence has been terminated, the relevant rate at which such fees and charges will be payable by You will be the rate which was payable immediately prior to termination.
- You authorise WSL to refuse You and Your agents access to the container and your goods, to access the unit and inspect and remove the Goods to another Room or Store; and to hold onto and/or ultimately dispose of some or all of your goods.
- In the event that any outstanding charges (including administration charges) are not paid within 30 days or You fail to collect the goods after WSL has required You to collect them or upon expiry or termination of this Licence, WSL may, subject to clause 21, sell your goods and pass all ownership to them and use the proceeds of sale to pay first the costs incurred by WSL and secondly in paying Your outstanding charges (including administration charges) and to hold any balance for You. Interest will not accrue to You on the balance;
- Before WSL sells the Goods, WSL will give you notice in writing of the amount of the outstanding charges and that in default of payment within 10 days of the date of the notice, that WSL will sell the Goods. WSL does not agree to give you any further notice of any intended sale. WSL will sell the Goods by any method(s) reasonably available to achieve a selling price reasonably obtainable in the open market, taking into account the costs of sale. If the Goods cannot reasonably and economically be sold (for any reason whatsoever) or they remain unsold despite WSL’ efforts, you authorise WSL to treat them as abandoned by You and to destroy or otherwise dispose of them at Your cost. You will pay the reasonable costs incurred in administering the debt collection and sale process described in this condition.
- WSL excludes all liability for loss or damage unless caused by his/her negligence or the negligence of staff.
- You agree to notify WSL of any changes to your contact details without undue delay.
- All goods must be removed from storage when the licence is terminated by either WCS or the client including any unwanted items, cardboard boxes etc. A charge of £100.00 plus VAT will be charged for cleaning if the unit/container is not left in a good condition.
